A ZAMBIA Army soldier has told the Lusaka High Court that he was not sure of who fired the bullet that killed National Prosecutions Authority (NPA) public prosecutor Nsama Nsama Chipyoka.
Jimmy Musuntula, 47, a warrant officer based at the Ministry of Defence at Cabinet Office, said on December 23, 2020 around 10:00 and 11:00 hours, he heard noise from outside the building and when he went to check what was happening, there was traffic outside.
He said after controlling traffic, he heard firing of teargas and everyone rushed for safety.
W/O Musuntula said he later heard gunshots as he was walking back to the building but he was not sure of who fired the bullet that killed Mr. Nsama but that there was heavy police presence around the area.
Another witness, Mr Amos Banda, 49, a security guard at Ministry of Works and Supply said on the material date he noticed a crowd standing next to the Presidential burial site and the British High Commission.
Mr. Banda said after asking his friends what was happening, he was told that the people who had gathered there were UPND supporters who had gone to give solidarity to their party president, Mr Hakainde Hichilema.
He said at first the crowd was peaceful and slightly around 08:00 hours there was some chanting and police then started dispersing them, after which teargas was fired.
He said later his colleague who works at the Ministry of Transport and Communication decided to go home and he escorted him.
Mr. Banda said as they reached the NPA, teargas reached them after which he went back to his duty point and closed the gate to prevent people from going in and out.
He said there was police presence from headquarters and later he and others saw people crying and upon checking they found a body lying by the restaurant.
In cross examination, he said he saw the body falling down but did not see the person who fired the shot. Trial continues on January 24, 2022.
