ZAMBIA Amateur Athletics Association (ZAAA) president Elias Mpondela and seven others have been dragged to court for alleged illegal stay in office.
According to a statement of claim filed in the Lusaka High Court by secretary of the Outreach Community Foundation Athletic Club secretary Stanford Kabwata and Chambeshi Athletics Club secretary Mulenga Chipoma, Mpondela and others have been accused of not being properly elected in accordance with the constitution.
Mpondela has been sued together with ZAAA general secretary Davison Mung’ambata, Godwin Chenda, Maureeen Nkolwe, Mutale Mpepo, Moses Phiri, Gertrude Siakalefya and Komani Ng’ambi.
The complainantts are seeking an injunction to restrain the ZAAA executive committee or their agents or servants from conducting their duties as they were illegally elected.
Among the reasons was that Mpondela’s election as president of ZAAA was illegal as he was not eligible to stand in terms of Article 10 (6) (c) of the constitution which provides that a person who is a delegate of an affiliated club or who is from an area board can stand for election if he or she filed in a nomination and qualifies to be elected.
And also that Mung’ambata covered the transport logistics, meals and other expenses for the delegates that attended the meeting which was contrary to the association’s constitution.
“An order for a declaration that the elections of the executive committee conducted and by Mung’ambata on 1st October, 2016 were done so illegally and as such null and void,”
They are asking for the declaration that an interim executive be put in place pending the court’s determination of the legality of the elections conducted.
