By GIDEON NYENDWA THE Zambia Institute of Chartered Accountants (ZICA) has raised concerns over the Zambia Revenue Authority (ZRA) Amendment Bill, particularly its provision granting immunity to members and staff. ZICA president Yande Mwenye has warned that the clause, which shields members from legal action for acts performed “in good faith,” could lead to abuse of authority and infringement on citizens’ rights. Ms Mwenye said the contentious provision states that no action or proceedings shall be instituted against ZRA staff for acts or omissions done in good faith while exercising their powers under the Act. Ms. Mwenye however criticised the absence of a clear framework to define what constitutes “good faith,” arguing that this ambiguity may create loopholes for potential misconduct. “We believe this clause should be suspended until a thorough framework study is conducted to clarify what the ZRA is attempting to address,” she said.
