THE Tanzania-Zambia Railway Authority (TAZARA) sued Likili Motorways Limited in the Lusaka High Court, seeking compensation exceeding K2.9 million and US$698, 000 following a 2023 collision involving one of its trains and a bus owned by the transport company.
According to a statement of claim, TAZARA, established under the Tanzania-Zambia Railway Act, operates as a bi-national railway company in Zambia and Tanzania. Likili Motorways is a Zambian-registered transport firm.
TAZARA stated that on July 2, 2023, its train No. M22 departed Kapiri Mposhi station around 12:38 hours. At approximately 13:09 hours, while the train was approaching a highway level crossing between Mpika and Sabwa Kabila, it collided with Likili’s bus, registration number BBC 3955.
The railway authority alleged the collision was a result of negligence by the bus driver, who failed to yield to the oncoming train.
TAZARA contended that the driver had a legal duty to exercise reasonable care and diligence on the road, especially near railway crossings.
The driver allegedly approached the railway crossing without properly assessing the situation, attempted or actually crossed the tracks while the train was present, and failed to slow down, stop, or take the necessary precautions required by law and common practice.
TAZARA claimed the driver’s reckless actions led to the bus being on or near the tracks as the train approached, resulting in a collision that caused the train to derail and capsize.
The accident caused extensive damage to the train, including its locomotives and wagons, as well as to the railway tracks.
In addition to the damage to infrastructure and equipment, the accident reportedly resulted in multiple casualties and fatalities among the bus passengers. TAZARA also cited financial losses due to the temporary closure of the line and significant expenses incurred during salvage and rescue operations. The railway company is seeking special damages amounting to K2, 925, 137.31 and US$698, 316 for the cost of replacing the damaged wagon, and repairs to locomotives DE 1000, ADD 3005, coach 2208, and wagon 748.
TAZARA is also claiming general damages for negligence, damages for breach of statutory duty, interest, and legal costs.
