THE Lusaka High Court has set February 7, 2025, as the date for ruling on whether Constable Funwell Nyundu has a case to answer in the fatal shooting of State prosecutor Nsama Chipyoka and UPND supporter Joseph Kaunda in December 2020.
Nyundu, who pleaded not guilty to two counts of murder, is accused of fatally shooting Chipyoka and Kaunda near the Cabinet office as police dispersed UPND supporters who had gathered to support then opposition leader, President Hakainde Hichilema, who was being questioned at Lusaka police headquarters.
The State has closed its case, and the court will now determine whether there is sufficient evidence for Constable Nyundu to answer.
The prosecution alleged that Nyundu was found to be in possession of an AK-47 rifle with the serial number EN 2650, identified as the firearm from which the fatal shots were fired.
During the trial, arresting officer Buyoya Simunza testified that after a thorough investigation, Nyundu was found to be in possession of the firearm.
However, under cross-examination by Nyundu’s lawyer, Willis Muhanga, Simunza revealed that he did not review the record of how the firearms at Lusaka Central Crack Squad were withdrawn on the day of the incident.
Simunza also stated that he did not know who the driver of the motor vehicle was on the day of the incident, where Nyundu claimed to have been.
Additionally, Simunza admitted that he did not interview the driver or investigate Nyundu’s alibi.
