FOOD Agents of Zambia limited, has been granted an interim injunction, stopping ETG Inputs Zambia Limited from removing bags of fertilizer from its warehouses.

This is according to an ex parte order of interim injunction dated July 11, 2023, endorsed by Judge Mbile Wina.
“It is hereby ordered and directed that the first defendant either by itself,its agents,servants and whomsoever is connected to it be is hereby restrained from removing bags of fertilizer from any and all of the properties of the plaintiff, stopping or blocking passage of the plaintiff ‘s goods within the Republic or indeed doing anything to or incidental to the same,” order Judge Wina.
This is in a matter where Food Agent Zambia has sued ETG Input Zambia limited, the Ministry of Agriculture and the Attorney General in the High Court.
The plaintiff wants the Ministry of Agriculture to pay K16, 560,000 for the supplied fertilizer as well as damages for breach of contract.
Food Agent Zambia in January, 2023, signed a won the contract with the Ministry of Agriculture for the supply of urea fertilizer valued.
And prior to the contract, the plaintiff sub contracted ETG Inputs Zambia Limited as exclusive agents on January 7,2023 which a Memorandum of Understanding was signed and on February 9, 2023 the Ministry of Agriculture were informed of the agreement and First Capital Bank Account No 0006203001673 Lusaka, was presented to the Ministry for payments.
According to the bank documents, Food Agent Zambia and ETG inputs Zambia limited supplied the urea fertilizer to the Ministry of Agriculture but that the Ministry has failed to pay the money agreed in the contract.
