SLAIN Prosecutor Nsama Nsama Chipyoka’s family has filed a lawsuit against the State demanding compensation for his death which includes special damages of more than K300, 000 and K1,185,770.84 for loss of expectations .
And family of UPND member Joseph Kaunda allegedly killed by Zambia Police Service officers has also sued the State claiming special damages amounting to K325, 000.
This is according to separate claims filed in the Lusaka High Court by ZS Legal Practitioners.
Both Mr Nsama Nsama and Kaunda were killed on December 23, 2020 when President Hakainde Hichilema as then opposition UPND leader, appeared at the police headquarters for questioning.
Mr Nsama, who was working as a senior public prosecutor for the National Prosecution Authority (NPA) died aged 44 while Kaunda, who was running a shop at Town Centre in Lusaka was 27 years old.
Mr Katele Nsama suing in his capacity as a beneficiary of the father’s estate and Mr Chaste Nsama, state that Mr Nsama was allegedly shot dead by the police in total violation of his right to life.
“The deceased died as a result of injury to the vital organs caused by a bullet that pierced his heart, lungs and liver. The deceased met his premature death in circumstances akin to execution style,” they contend.
They state that the victim left behind four children aged 21 (Mr Katele), 15, 14 and a one year-old-baby.
Mr Nsama Nsama’s parents’ aged 82 and 83 were also reliant on him.
“Damages for loss of expected life K5 000. Loss of dependency by the family K1, 180, 770.87 (monthly basic salary K14, 103.45 less one third contingencies by 12 months by 21 years bringing total to K1,185,770.84,” they state.
The family therefore claims damages for loss of life expectation of the deceased and for loss of reasonable expectation of pecuniary benefit.
They are also claiming damages for the negligent act of the police, special damages in the sum of K329.500 and interest on sums payable at the current Bank of Zambia lending rate.
And late Mr Kaunda’s representative, Mr David Katongo said he left behind two children aged seven and five and two other dependents including his 67 year old mother.
The family claims damages for loss of life expectation of the deceased and for loss of reasonable expectation of pecuniary benefit.
Proceedings in the killing of the two are before the Lusaka High Court with a police officer, Fanwell Nyundu as the accused person.
