EIGHT expelled Patriotic Front (PF) members of Parliament have discontinued their ex parte summons for leave to apply for judicial review of their expulsion from the National Assembly after nullification of their election.
The PF MPs discontinued the case after their lawyers, Makebi Zulu Advocates filed a notice of discontinuance in the Lusaka High Court, indicating that they have forthwith discontinued their application for an order for leave to move to judicial review dated December 7, 2021.
A panel of High Court Judge-in-Charge Gertrude Chawatama and Judges Mwila Kombe and Susan Wanjelani was yesterday scheduled to deliver ruling on the MPs’ application but adjourned the ruling to a later date that was to be communicated to the lawyers.
The eight MPs are Bowman Lusambo (Kabushi), Joe Malanji (Kwacha), Allen Banda (Chimwemwe), Kalalwe Mukosa (Chinsali), Mutotwe Kafwaya (Lunte), Christopher Chibuye (Mkushi North), Taulo Chewe (Lubansenshi), and Lucas Simumba (Nakonde).
PF Kasama Central MP Sibongile Mwamba, who is also affected by Speaker of the National Nelly Mutti’s decision to expel the MPs, was not party to the application for leave to apply for judicial review.
Last week, the Law Association of Zambia (LAZ) filed originating summons in the Constitutional Court, seeking interpretation of Articles 72 (2) (h) and 73 (1) (2), and (4) of the Constitution of Zambia and cited the Attorney General as respondent.
