THE Choma magistrate court has thrown out a case in which two musicians were charged for allegedly defaming former President Edgar Lungu.
In this matter, Augustine Kaunda of Chikankanta, aged 26 was charged with Gift Hachilama, aged 20 of Macha for defamation of the president contrary to the laws of Zambia.
They allegedly insulted the president in a song.
The duo is accused of intentionally bringing the name of the president into hatred and ridicule by publishing a defamatory matter through writing and producing a song.
Kaunda and Hachilama pleaded innocent when they appeared for plea and testified that there was nothing defamatory about the song.
However, the state failed to proceed with trial after a number of adjournments due to the absence of the state witnesses.
Senior Resident Magistrate Peter Mungala has since discharged the accused persons.
Mr Mungala threw away the case after the state failed to bring witnesses in court from June this year when the case started.
The court overlooked the application by the state to buy more time for them to bring witnesses in court.
