A 35-YEAR-OLD man has been fined K500 and ordered to compensate the complainant after stealing a television set from a lodge contrary to section 272 of the penal code chapter 87 of the laws of Zambia in the first count.
Particulars of the offense are that Mark Dimba Musa on 10 November, 2021 at Choma District in the Southern Province did steal a television set valued at K1,300 property of Eltimus Lodge.
And in the second count Mr Musa is charged with assault occasioning actually bodily harm and particulars of the offence are that on 18 October 2021 at Choma District, did assault Pumulo Muliwana thereby occasioning her actual bodily harm.
After admitting to the charges, magistrate Muyambango Munukayumbwa found the accused guilty.
In his mitigation, Mr Musa asked for the court’s lenience saying he is a single parent looking after his six children and his mother was unwell.
Magistrate Munukayumbwa considered the mitigation and fined the accused K500 for the first count and ordered him to compensate the complainant with K300.
The court also treated the accused as a first time offender as both crimes were committed during the same period.
Magistrate Munukayumbwa further adjourned the Matter in the second count to 6 December 2021 for trial while the accused remains in custody.
