A 23-YEAR-OLD Somali housewife has been discharged in a case in which she was alleged to have poisoned her husband.
Amina Mohammed was alleged to have poisoned her husband, Osman Mohammed Adam on 2nd March 2017 in Lusaka.
When the matter came up for commencement of trial before Judge Susan Wanjelani yesterday, the prosecution told the court that they were discontinuing with the matter.
“We are unable to proceed with the matter. We are discontinuing with the matter by way of a Nolle Prosequi.”
However, Justice Wanjelani told the accused that she was free to go as the State had decided to discontinue the matter but that should they wish to prosecute her in the future, they had the right to re-arrest her for the same matter.
“The State has entered a Nolle Prosequi which means that they will not proceed but should they wish to do so in the future, they have the right to re-arrest you and bring you to court for the same matter, now you are free to go,” said Justice Wanjelani.
During the last sitting, the prosecution informed the court that they had failed to locate witnesses in the matter.
