GOTV Broadcasting Limited has discontinued the matter in which it had sued ZNBC, Top Star and the Attorney General in the Lusaka High Court seeking an injunction to compel the national broadcaster to immediately restore the free-to-air services on the GOtv digital terrestrial television.
Through a Consent order on discontinuance of action, the parties in the matter consented to settle the matter outside court.
Earlier this year, GOtv saught a court order to restrain ZNBC from disconnecting their services and from continuing to encrypt the signal transmitted by free-to-air content providers.
It was also seeking a declaration that the operation of the public signal distribution network by Top Star, was illegal and unlawful.
GOtv, submitted that ZNBC was a shareholder in GOtv and that the remaining shares were being held by Multi Choice Africa Limited, a company incorporated in Mauritius.
GOtv further stated that from June 2015, it had received broadcasting transmission of free-to-air channels from ZNBC.
It stated that earlier in 2014, the Ministry of Information and Broadcasting Services published a digital migration policy from analogue to digital terrestrial broadcasting.
GOtv also indicated that ZNBC engaged the said free-to-air content providers with a view of enforcing payment of applicable tariffs.
It stated further that on January 24 this year, its acting managing director wrote to ZNBC seeking confirmation of the proposed disconnection of free-to-air channels from GOtv’s digital terrestrial television platform.GO
